Agreement to Terms

By installing or using mssg.it ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Description of Service

mssg.it is a browser extension that works alongside WhatsApp Web to help users manage and send messages to their existing WhatsApp contacts. The Service is designed to facilitate thoughtful, intentional, and respectful communication, with built-in safeguards intended to prevent overuse, unwanted messaging, and abuse.

Not Affiliated with WhatsApp

mssg.it is an independent product and is not affiliated with, endorsed by, or sponsored by WhatsApp LLC, Meta Platforms, Inc., or any of their affiliates. "WhatsApp" is a trademark of WhatsApp LLC.

Your use of WhatsApp is governed solely by WhatsApp's own Terms of Service and policies. You are solely responsible for ensuring that your use of mssg.it complies with all applicable WhatsApp rules and guidelines.

Acceptable Use

You agree to use mssg.it only for lawful purposes and in accordance with these Terms. You agree NOT to use the Service to:

  • Send spam, unsolicited messages, or messages to recipients who have not consented to be contacted
  • Continue messaging any person who has asked you to stop or who has otherwise indicated they do not wish to receive messages
  • Send bulk, automated, or high-frequency messages that are likely to be perceived as abusive, intrusive, or spammy
  • Harass, abuse, threaten, or harm other individuals
  • Send messages that violate applicable laws or regulations
  • Impersonate others or misrepresent your identity or affiliation
  • Distribute malware, phishing attempts, or malicious content
  • Circumvent, disable, or attempt to bypass rate limits, safety features, or usage constraints built into the Service
  • Violate WhatsApp's Terms of Service, acceptable use policies, or enforcement guidelines
  • Use automated scripts, bots, scrapers, or data-harvesting tools in conjunction with the Service
  • Collect, extract, or store WhatsApp contact data, profile information, or message content in ways not explicitly supported by the Service

Recipient feedback, blocking, or reporting may be treated as evidence of misuse, regardless of intent.

User Responsibilities

You are solely responsible for:

  • All messages sent using the Service
  • Ensuring you have appropriate consent or an existing relationship with message recipients
  • Honoring opt-out requests immediately and without exception
  • The content, timing, and frequency of your communications
  • Maintaining the security and integrity of your WhatsApp account
  • Complying with all applicable laws, including data protection and anti-spam regulations

You acknowledge that improper use of the Service may result in restrictions, suspension, or permanent bans imposed by WhatsApp, for which mssg.it bears no responsibility.

Subscriptions and Payment

mssg.it offers paid subscription plans. By subscribing:

  • You authorize us to charge your selected payment method on a recurring basis
  • Subscriptions automatically renew unless canceled before the renewal date
  • You may cancel your subscription at any time through your account settings
  • Refunds are handled on a case-by-case basis at our discretion
  • Prices may change with notice; continued use constitutes acceptance

Payments are processed securely by Stripe; we do not store payment card details.

Service Availability

We strive to provide reliable service, but we do not guarantee uninterrupted availability. The Service may be unavailable due to:

  • Maintenance or updates
  • Changes to WhatsApp Web or its internal systems
  • Technical issues beyond our control
  • Actions taken by WhatsApp, Meta, or related platforms

We are not liable for any losses, disruptions, or account actions resulting from such events.

Intellectual Property

mssg.it, including its software, design, and content, is owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works from the Service without prior written permission.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "as is" without warranties of any kind
  • We are not liable for indirect, incidental, special, consequential, or punitive damages
  • We are not liable for impacts to your WhatsApp account, including warnings, restrictions, or bans
  • Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim

Indemnification

You agree to indemnify and hold harmless mssg.it from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of WhatsApp's policies or applicable laws
  • Any claims by third parties related to your communications

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, including for:

  • Violations of these Terms
  • Suspected abusive, automated, or high-risk messaging behavior
  • Attempts to bypass safety controls
  • Non-payment of subscription fees
  • Any reason at our sole discretion

You may terminate your use at any time by uninstalling the extension and canceling your subscription.

Changes to Terms

We may update these Terms periodically. Material changes will be communicated through the Service or website. Continued use after changes constitutes acceptance.

Governing Law

These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the courts of that jurisdiction.

Severability

If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
